Comparing legal approaches arising from humanitarian visa litigation concerning the Palestinian population of Gaza. Conference organized by ASGI, Roma Tre University – Department of Law, and the Legal Clinic.

The rationale of the seminar

THE RATIONALE OF THE SEMINAR

Recent Italian and European litigation concerning humanitarian visas, access to diplomatic and consular missions, and the possibility of leaving Gaza has brought a fundamental legal question back to the forefront: whether, and under what conditions, the protection obligations incumbent on States may have legal effects even before a foreign national enters national territory and may require the adoption of measures capable of enabling such access.

In Italy, this issue engages the constitutional right of asylum, European Union law and international obligations to protect fundamental rights. At the same time, it raises significant questions concerning the effectiveness, scope and limits of judicial protection.

Taking as its starting point the litigation concerning humanitarian visas for Palestinians in Gaza, the seminar seeks to bring into dialogue the different legal approaches that have emerged in legal scholarship and case-law, to identify the unresolved questions of interpretation, and to assess what avenues the legal order provides – and what limits it imposes for ensuring effective access to protection where reaching the territory is itself a necessary precondition for obtaining it.

Venue, time, and date: Friday, 30 October 2026, 9:15 a.m. – 6:30 p.m., held in person at the Aula Magna · Department of Law · Roma Tre University · Rome, as well as online.

Participation and accreditation: Free event open to all interested individuals, subject to mandatory registration via this form. Accreditation by the Rome Bar Council for continuing legal education credits (CLE) is currently pending for in-person attendees.
