{"id":111957,"date":"2020-06-11T14:44:25","date_gmt":"2020-06-11T12:44:25","guid":{"rendered":"https:\/\/www.asgi.it\/sciabaca-oruka\/petition-to-european-parliament-challenging-eus-material-support-to-libyan-abuses-against-migrants\/"},"modified":"2025-01-07T12:59:55","modified_gmt":"2025-01-07T11:59:55","slug":"petition-to-european-parliament-challenging-eus-material-support-to-libyan-abuses-against-migrants","status":"publish","type":"sciabaca-oruka","link":"https:\/\/www.asgi.it\/en\/sciabaca-oruka\/petition-to-european-parliament-challenging-eus-material-support-to-libyan-abuses-against-migrants\/","title":{"rendered":"Petition to European Parliament Challenging EU\u2019s Material Support to Libyan Abuses Against Migrants"},"content":{"rendered":"\n<h5 class=\"wp-block-heading\">Today, Global Legal Action Network (GLAN), and two Italian NGOs, the Association for Juridical Studies on Immigration (ASGI), and the Italian Recreational and Cultural Association (ARCI) filed a Petition to the European Parliament under Article 227 of the Treaty of the European Union, concerning the Mismanagement of EU Funds by the EU Trust Fund for Africa\u2019s \u2018Support to Integrated Border and Migration Management in Libya\u2019s IBM Programme.  <\/h5>\n\n\n\n<div class=\"wp-block-kadence-spacer aligncenter kt-block-spacer-_8e5b5d-4a\"><div class=\"kt-block-spacer kt-block-spacer-halign-left\" style=\"height:20px\"><hr class=\"kt-divider\" style=\"border-top-color:rgba(238, 238, 238, 1);border-top-width:1px;width:80%;border-top-style:solid\"\/><\/div><\/div>\n\n\n\n<p class=\"has-text-color has-vivid-red-color wp-block-paragraph\"><a href=\"https:\/\/sciabacaoruka.asgi.it\/wp-content\/uploads\/2020\/06\/GLAN-ASGI-ARCI-EP-petition-IBM-in-Libya-with-annexes.pdf\">GLAN ASGI ARCI EP Petition with annexes<\/a><\/p>\n\n\n\n<div class=\"wp-block-kadence-spacer aligncenter kt-block-spacer-_2ceb69-a0\"><div class=\"kt-block-spacer kt-block-spacer-halign-left\" style=\"height:20px\"><hr class=\"kt-divider\" style=\"border-top-color:rgba(238, 238, 238, 1);border-top-width:1px;width:80%;border-top-style:solid\"\/><\/div><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">This filing is part of a <a href=\"https:\/\/www.glanlaw.org\/eu-complicity-in-libyan-abuses\">broader initiative<\/a> by the three organisations to challenge the EU&#8217;s material support and complicity in illegal push-backs. A coalition of thirteen NGOs backed these efforts in a <a href=\"https:\/\/c5e65ece-003b-4d73-aa76-854664da4e33.filesusr.com\/ugd\/14ee1a_0f9f9fb7d3e247d79c0d5b57db362d85.pdf\">statement<\/a> that calls on the EU to review and remedy its cooperation with Libya and end its involvement in the containment of individuals in Libya and its resultant exposure of migrants to egregious abuses by Libyan actors \u2013 acts that make Libya an \u2018unsafe country\u2019 from the <a href=\"https:\/\/www.glanlaw.org\/ss-case\">perspective<\/a> of the European Convention on Human Rights, and include potential crimes against migrants <a href=\"https:\/\/www.icc-cpi.int\/Pages\/item.aspx?name=191106-stat-icc-otp-UNSC-libya\">under investigation<\/a> by the International Criminal Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On\n27 April 2017, GLAN, ASGI and ARCI&nbsp;<a href=\"https:\/\/www.glanlaw.org\/eu-complicity-in-libyan-abuses\">submitted<\/a>&nbsp;a\ncomplaint to the European Court of Auditors (ECA)\nrequesting the review and reform of the EUTFA\u2019s programme funding\nmigration management in Libya implemented by the Italian Interior\nMinistry and benefits the Libyan coast guard.  The programme is\nillegal for using European development funds for the\nnon-developmental purposes of border securitization, and for managing\nsuch funds without proper human rights safeguards and conditionality\nin contravention of EU law requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On\n18 May\n2020,\nthe ECA responded to the complaint stating that\nit\nwill not initiate a special review of the programme at this time, due\nin part to limited resources.\nThis Court did commit to \u201ccarefully\nanalyse\u201d\nthe submission\nduring its\nannual programming process, as\nwell as in the context of\nits\nplanned follow-up\nto\nits 2018\nSpecial\nReport\non\nthe\nEUTFA. \n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This\nPetition\nto the\nEuropean\nParliament&#8217;s Petitions\n(PETI)\nCommittee <a href=\"https:\/\/www.europarl.europa.eu\/at-your-service\/en\/be-heard\/petitions\">aims<\/a>\nto place the issues raised by the complaint onto the agenda of a\ncross-section of European Parliament committees, and to mobilise the\nParliament to address these issues under its budgetary and oversight\nauthority over the use of European development funds. The\nPETI\nCommittee\nsupervises\nthe EU\u2019s\nmigration cooperation in the Mediterranean, and has <a href=\"\/Users\/valentinaazarova\/Desktop\/GLAN\/final%20ECA%20complaint%20docs\/europarl.europa.eu\/doceo\/document\/A-8-2016-0066_EN.html\">maintained<\/a>\nthat migration cooperation \u201cby the EU\n[\u2026]\nneeds to be regularly monitored and evaluated [\u2026] and, if\nnecessary, adjusted or enhanced to ensure [\u2026] respect for\nfundamental rights.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The\norganisations, as EU-registered NGOs, asked the PETI Committee to\nreview the compliance of the Libya migration-management programme\nwith EU law, in cooperation with relevant Parliamentary committees\nand through engagement with the EU Commission, and to recommend the\nappropriate means and measures to remedy this situation.\nSpecifically, we request that the Committee: \n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\na) Initiate\nmeaningful inquiry into the misuse of European\ndevelopment funds by the EUTFA\u2019s Libya programme;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\nb) Take steps\nto ensure that the irregularities caused by the programme be\neffectively addressed by the ECA in its follow-up to its 2018 Special\nreport on the EUTFA; \n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\nc) Make\nconcrete recommendations and take steps to remedy these\nirregularities in\nthe use of the EU budget, and\naddress other relevant EU institutions and procedures, including the\nEuropean Parliament\u2019s approval of the EU\u2019s budget through the\n<a href=\"https:\/\/www.europarl.europa.eu\/news\/en\/headlines\/eu-affairs\/20150427STO46470\/discharge-procedure-how-parliament-scrutinises-the-eu-budget#:~:text=The%20discharge%20procedure%20is%20the%20Parliament's%20final%20approval%20of%20how,specific%20year%20has%20been%20implemented.&amp;text=Parliament%20considers%20the%20reports%20prepared,postpone%20or%20refuse%20a%20discharge.\">\u2018discharge\nprocedure\u2019<\/a>;\n\n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\nd) Engage\nparliamentary committees with relevant mandates and existing interest\nin the issues raised by this Petition; and \n<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\ne) Consider\nreferring this matter to OLAF.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the <a href=\"https:\/\/www.avvenire.it\/attualita\/pagine\/accordo-malta-libia-respingimento-migranti?fbclid=IwAR1qRx_osRIDGCsEQQKHeqJVNDnRDfKSpvrLCXHugejrwLMqXH3LJCNBNGk\">Memorandum<\/a> of Understanding between Libya and Malta on \u201ccombatting illegal immigration,\u201d Malta has supported an increase the EU Commission funding to the Libyan authorities to help them in \u201csecuring the southern borders of Libya\u201d. We are concerned that like the EU\u2019s other external funding programmes in support of border control and migration management, financial support for Malta\u2019s migration cooperation with Libya would be provided through the EUTFA, and would thus replicate the financial and other illegalities of the Libya programme.
