Spain<\/a>\u00a0from 13 February 2020 the European Court of Human Rights (EctHR) Grand Chamber took a historical step back from its previous case law on guarantees against collective pushbacks of migrants seeking international protection.<\/p>\n\n\n\n<p>The\ncase concerns\ntwo North African migrants who, as a part of a larger group of\nof around 75 to 80 persons,\ncrossed the border fence into the Spanish enclave of Melilla, in\nMorocco, and were forcibly and summarily deported by Spanish\nauthorities back into Moroccan territory.<\/p>\n\n\n\n<p>The\nECtHR&nbsp;<a href=\"http:\/\/hudoc.echr.coe.int\/eng?i=001-177683\">chamber\njudgment<\/a>&nbsp;in\nOctober 2017 had ruled that the ECHR was applicable and that Spain\nhad violated the prohibition of collective expulsion vis-\u00e0-vis the\ntwo individuals. The case was then referred to the Grand Chamber\nwhich (similarly to what it did in the case of <a href=\"http:\/\/www.asgi.it\/wp-content\/uploads\/2016\/12\/CASE-OF-KHLAIFIA-AND-OTHERS-v.-ITALY.pdf\">Khlaifia\nv. Italy in 2016<\/a>)\nreversed the judgment and took an opposite and unprecedented view,\nholding that the illegal border crossing by the two migrants\nlegitimized their subsequent summary deportation. \n<\/p>\n\n\n\n<p>Article\n4 of Protocol No. 4 of the ECHR\nsimply reads \u201cCollective\nexpulsion of aliens is prohibited\u201d. \n<\/p>\n\n\n\n<p>In\nthe judgment at stake, the Grand Chamber first confirmed its\nwell-established view that\npushbacks\nat\nthe border fall within the notion of \u201ccollective expulsions\u201d.\nHowever, the\nCourt held\nthat Spanish\nauthorities did\nnot violate protocol 4, even if they failed to examine\nthe individual circumstances of the two applicants.\nThe\nCourt gave particular\nweight to the\napplicants\u2019\nconduct,\nconsisting in crossing\nthrough\nan unauthorized land border, in\nlarge numbers and\nwith\nthe\nalleged\nuse\nof force. \n<\/p>\n\n\n\n<p>Moreover,\nthe\nCourt placed\nparticular weight on the fact that the\napplicants could\nand should\nhave sought asylum at\nthe\n\u201cBeni\nEnzar international border crossing\u201d.\nAlthough\nUNHCR had already clarified that,\nat the time, it\nwas\nnot possible\nto seek asylum at this border\ncrossing, since there\nwas no system capable of identifying people in need of international\nprotection, the Court endorsed\nthe\nopposite\nposition of\nthe Spanish government authorities, according to whom \u201cthere\nwas an effective possibility to present such applications\u201d.<\/p>\n\n\n\n<p>This\nunderscores once again the\ndetrimental\nrole\nplayed by so-called \u201capparent\nguarantees\u201d,\ni.e. mechanisms put in place by a State\nto\nformally protect a specific right (in\nthis case:\nthe\ntheoretical possibility to\nlodge\nan\nasylum application\nat the border)\nbut\nin\nfact devoid of any\nsubstantive content.<\/p>\n\n\n\n<p>Although\npushbacks at the\nborder with Morocco represent a long-standing practice\n(this\npart of \u201cFortress Europe\u201d was built over\n20\nyears ago\nand\nhas\nbeen criticized by human\nrights organisations ever\nsince) this is the first EctHR judgement on the issue.
