{"id":117457,"date":"2022-09-19T13:27:56","date_gmt":"2022-09-19T11:27:56","guid":{"rendered":"https:\/\/www.asgi.it\/anti-discrimination\/journalist-appeals-to-the-echr-knowing-how-public-funds-are-used-in-libya-is-a-legal-right\/"},"modified":"2024-12-20T14:13:02","modified_gmt":"2024-12-20T13:13:02","slug":"journalist-appeals-to-the-echr-knowing-how-public-funds-are-used-in-libya-is-a-legal-right","status":"publish","type":"post","link":"https:\/\/www.asgi.it\/en\/news\/journalist-appeals-to-the-echr-knowing-how-public-funds-are-used-in-libya-is-a-legal-right\/","title":{"rendered":"Journalist appeals to the ECHR: knowing how public funds are used in Libya is a legal right"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/en.asgi.it\/wp-content\/uploads\/2022\/09\/human-rights-diritti-umani-1024x683.jpg\" alt=\"human rights are not optional\" class=\"wp-image-36815\"\/><\/figure>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>After being refused information by the Italian Ministry of the Interior, the Administrative Court and the Council of State, freelance journalist and member of the International Federation of Journalists Sara Creta, supported by ASGI lawyers, lodges an appeal before the European Court of Human Rights (ECHR) to enforce Article 10 of the ECHR Convention.<\/p><\/blockquote>\n\n\n\n<p>In October 2020, the journalist submitted a freedom of information (FOI) request to the Italian Ministry of Interior to find out&nbsp;<strong>how financial resources are used in Libya under the SIBMMIL project&nbsp;<\/strong>(\u2018Support to Integrated Border and Migration Management in Libya \u2013 first phase\u2019), implemented by the Italian MoI.<\/p>\n\n\n\n<p>This is a funding of EUR 46 million \u2013 approximately 42 of which come from the European Emergency Trust Fund for Africa \u2013 intended to strengthen the operational capacities of the Libyan authorities in land and maritime border management activities. B<strong>y providing Libyan authorities with equipment as well as technical and political assistance, the project facilitates the interception of migrants and refugees in the Central Mediterranean and their return to the cruel and inhuman conditions of torture and slavery in the North African country\u2019s detention centres.<\/strong><\/p>\n\n\n\n<p>Despite civil society has a clear interest in obtaining information on the use of public funds in Libya, especially in light of their serious impact on people\u2019s rights,<strong>&nbsp;the MoI, the Administrative Court and the Council of State rejected the journalist\u2019s request&nbsp;<\/strong>arguing that the disclosure of documents would pose a risk to international relations and public safety. However, the decision to refuse access and the two judgments do not explain what these risks might be.<\/p>\n\n\n\n<p>Ms. Creta \u2013 represented by ASGI lawyer Luce Bonzano \u2013 decided to submit the case to the ECHR\u2019s scrutiny, claiming a&nbsp;<strong>violation of her right to freedom of expression, as enshrined in Article 10 of the ECHR<\/strong>&nbsp;Convention: \u201cEveryone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers\u201d.<\/p>\n\n\n\n<p>For Ms. Creta, the refusal to disclose information amounts to&nbsp;<strong>interference with the exercise of her right to report<\/strong>, preventing her from providing accurate and reliable information and thus from exercising&nbsp;<strong>public scrutiny (as a public watchdog<\/strong>), which is essential in any democratic society.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>It is fundamental for journalists to have non-discriminatory access to information. For a long time now, total opacity in the management of Italian and European funds in Libya has been accompanied by serious human rights violations.
