{"id":117442,"date":"2022-06-08T10:20:00","date_gmt":"2022-06-08T08:20:00","guid":{"rendered":"https:\/\/www.asgi.it\/anti-discrimination\/new-schengen-borders-code-to-legitimise-racial-profiling-at-the-border\/"},"modified":"2024-12-20T14:13:03","modified_gmt":"2024-12-20T13:13:03","slug":"new-schengen-borders-code-to-legitimise-racial-profiling-at-the-border","status":"publish","type":"post","link":"https:\/\/www.asgi.it\/en\/news\/new-schengen-borders-code-to-legitimise-racial-profiling-at-the-border\/","title":{"rendered":"New Schengen Borders Code to legitimise racial profiling at the border"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/en.asgi.it\/wp-content\/uploads\/2021\/07\/confine-controllo-polizia-cpr-screening-1024x683.jpg\" alt=\"border\" class=\"wp-image-36551\"\/><\/figure>\n\n\n\n<p>Ahead of an EU Justice and Home Affairs Ministers meeting on 9-10 June to discuss the&nbsp;<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:52021PC0891&amp;from=EN\" target=\"_blank\" rel=\"noreferrer noopener\">reform of the Schengen Borders Code<\/a>, a coalition of almost 40 NGOs, in a&nbsp;<a href=\"https:\/\/picum.org\/joint-civil-society-statement-schengen-borders-code\/\" target=\"_blank\" rel=\"noreferrer noopener\">joint statement<\/a>, denounces the risk of more racial profiling and other fundamental rights violations under the proposed new rules.<\/p>\n\n\n\n<p>The Schengen Borders Code regulates border controls at the internal and external borders of the Schengen area, and essentially prohibits internal checks as a rule, with some limited exceptions. The reform \u2013 proposed by the Commission in December 2021 and currently being discussed by the EU Council and the Parliament \u2013 maintains this general prohibition on internal checks on paper, but at the same time allows police to carry out checks at internal border areas to \u201cprevent irregular migration\u201d (Recitals 18 and 21 and Article 23).<\/p>\n\n\n\n<p>Since systematic checks are prohibited, it is clear that \u201crandom\u201d document checks will depend on police\u2019s decisions about who \u201clooks like\u201d a person without valid papers. Research (see Notes) has already shown that police tend to stop people for checks based on racial, ethnic, or religious characteristics: the new Schengen Borders Code will exacerbate this trend of&nbsp;<strong>racial profiling<\/strong>.<\/p>\n\n\n\n<p>The new Code also introduces the possibility for joint police patrols to apprehend people caught without a valid document at internal borders, detain them for up to 24 hours and transfer them to the EU state they think the person came from, without any individual assessment. This&nbsp;<strong>\u201cinternal pushback\u201d and the ensuing detention<\/strong>&nbsp;would also apply to children, even though this has been&nbsp;<a href=\"https:\/\/www.lacimade.org\/presse\/frontiere-franco-italienne-associations-avocat%c2%b7e%c2%b7s-respecter-droit-enfants-etrangers-devant-tribunal-administratif-de-nice\/\" target=\"_blank\" rel=\"noreferrer noopener\">deemed illegal<\/a>&nbsp;by courts and despite international consensus that child detention constitutes a&nbsp;<a href=\"https:\/\/www.refworld.org\/docid\/5a12942a2b.html\" target=\"_blank\" rel=\"noreferrer noopener\">human rights violation<\/a>.<\/p>\n\n\n\n<p>The proposal escalates the use of&nbsp;<strong>monitoring and surveillance technologies<\/strong>&nbsp;like biometric identification technologies and AI-based automated decision-making systems that do not apply relevant safeguards and would be at odds with existing&nbsp;<a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2016\/679\/oj\" target=\"_blank\" rel=\"noreferrer noopener\">EU data protection legislation<\/a>&nbsp;and the currently debated&nbsp;<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A52021PC0206\" target=\"_blank\" rel=\"noreferrer noopener\">Artificial Intelligence Act<\/a>.<\/p>\n\n\n\n<p>Lastly, the new Code introduces measures that would&nbsp;<strong>limit the possibility for people to seek asylum<\/strong>&nbsp;in the EU in situations of \u201cinstrumentalisation of migration\u201d. In particular, the reform steps up Frontex\u2019s involvement and allows member states to limit the number of border crossing points and their opening hours, and to intensify border surveillance including through drones, motion sensors and border patrols.<\/p>\n\n\n\n<p>According to Marta Gionco, Advocacy Officer at the Platform for International Cooperation on Undocumented Migrants (PICUM),&nbsp;<strong>\u201cAs it stands now, the new Schengen Borders Code would turn the Schengen area into a tech-controlled space where racial profiling gets&nbsp;<em>de facto&nbsp;<\/em>legitimised, access to asylum is curtailed and freedom of movement is undermined\u201d.<\/strong><\/p>\n\n\n\n<p>Stephanie Pope, EU Migration Policy Advisor, Oxfam International:&nbsp;<strong>\u201cFor years, European leaders have shut their eyes to pushbacks. Now the EU is going one step further with an attempt to legalise and legitimise them and other human rights violations happening at Europe\u2019s borders. Where is the condemnation? Where is the commitment to human rights?
