In Limine is an ASGI project that addresses the hotspot approach, border management policies, and access to asylum procedures. Through field research, strategic litigation, and advocacy, the project develops strategies to expose and counter practices that hinder freedoms and rights of migrants arriving in Italy, particularly with regard to the deprivation of personal liberty.
Active since 2019 with the support of the Open Society Foundation, the project involves a team of legal practitioners and mediators based in Sicily. They primarily operate in Pozzallo, Trapani, Caltanissetta, Porto Empedocle, and Lampedusa, as well as in other border locations where incoming individuals face detention, including Albania.
The project also aims to provide a systematic analysis of the laws and their dynamic relationship with society, revealing the true nature of border management policies.
The team works with the support of a committee of experts consisting of specialized jurists and a mobile group of lawyers. This group is available to intervene upon the team’s request to protect foreign individuals, effectively addressing observed violations by initiating litigation—including strategic litigations—before national and international courts.
The InLimine project seeks to facilitate the creation of networks and forms of cooperation that, through close scientific and operational collaboration, can lead to the replication of similar experiences in border regions. This aims to ensure a more widespread and consistent effort to counteract the criminalization of individuals in transit who enter Italian territory.
En Limine est un projet ASGI qui se concentre sur l’approche des hotspots, les politiques de gestion des frontières et l’accès aux procédures d’asile. À travers la recherche de terrain, le contentieux stratégique et le plaidoyer, le projet développe des stratégies de dénonciation et de lutte contre les pratiques portant atteinte aux libertés et aux droits des personnes migrantes arrivant en Italie, en particulier en ce qui concerne la privation de liberté personnelle.
Actif depuis 2019 grâce au soutien de la Open Society Foundation, le projet mobilise un groupe d’opérateurs juridiques et de médiateurs basés en Sicile, intervenant principalement à Pozzallo, Trapani, Caltanissetta, Porto Empedocle et Lampedusa, ainsi que dans d’autres zones frontalières où les personnes arrivant sont retenues, comme en Albanie.
Le projet vise également à restituer, par une lecture systématique des normes et de leur relation dynamique avec la société, la véritable nature des politiques de gestion des frontières.
L’équipe travaille avec le soutien d’un comité d’experts composé de juristes spécialisés et d’un groupe mobile d’avocats, prêt à intervenir à la demande de l’équipe sur le terrain pour protéger les personnes étrangères, en agissant concrètement sur les violations constatées par le biais de contentieux, y compris stratégiques, devant les juridictions nationales et internationales.
Le projet En Limine se propose de faciliter la création de réseaux et de formes de coopération qui, dans une connexion scientifique et opérationnelle étroite, puissent mener à multiplier sur les territoires frontaliers des expériences similaires, pour une action plus étendue et constante de lutte contre les politiques de criminalisation des personnes en mouvement entrant sur le territoire italien.
In Limine è un progetto ASGI che si occupa dell’approccio hotspot, delle politiche di gestione delle frontiere e dell’accesso alle procedure di asilo. Attraverso la ricerca sul campo, il contenzioso strategico e l’advocacy, il progetto sviluppa strategie di denuncia e contrasto delle pratiche lesive delle libertà e dei diritti delle persone migranti in arrivo in Italia, soprattutto con riferimento alla privazione della libertà personale.
Attivo dal 2019, grazie al sostegno di Open Society Foundation, il progetto coinvolge un gruppo di operatori legali e mediatori presente in Sicilia, che opera prevalentemente nelle località di Pozzallo, Trapani, Caltanissetta, Porto Empedocle e Lampedusa, oltre che in altri luoghi di frontiera dove le persone in arrivo sono soggette a trattenimento, tra questi l’Albania.
Il progetto si propone inoltre di restituire, attraverso una lettura sistematica delle norme e del loro rapporto dinamico con la società, la reale natura delle politiche di gestione delle frontiere.
Il team lavora con il sostegno di un comitato di esperti costituito da giuristi specializzati e di un gruppo mobile di avvocati, disponibile a intervenire su richiesta del team in loco per tutelare le persone straniere intervenendo fattivamente sulle violazioni riscontrate tramite la presentazione di contenzioso anche strategico di fronte alle Corti nazionali ed internazionali.
Il progetto In Limine si propone di facilitare la creazione di reti e forme di cooperazione che, in stretto collegamento scientifico e operativo, possano condurre a moltiplicare sul territorio di frontiera esperienze similari, per una più capillare e costante azione di contrasto delle politiche di criminalizzazione delle persone in movimento che fanno ingresso sul territorio italiano.
إن ليمين هو مشروع تابع لـ ASGI يركز على نهج “النقاط الساخنة”، وسياسات إدارة الحدود، والوصول إلى إجراءات اللجوء. من خلال البحث الميداني، والتقاضي الاستراتيجي، والدعوة، يطور المشروع استراتيجيات للتنديد ومواجهة الممارسات التي تنتهك الحريات وحقوق المهاجرين الوافدين إلى إيطاليا، خاصة فيما يتعلق بالحرمان من الحرية الشخصية.
منذ انطلاقه في عام 2019 بدعم من مؤسسة Open Society Foundation، يضم المشروع فريقاً من العاملين القانونيين والمترجمين الثقافيين الموجودين في صقلية. يعمل الفريق بشكل أساسي في مواقع مثل بوزالو، تراباني، كالطانيستا، بورتو إمبيدوكلي، ولامبيدوزا، بالإضافة إلى مواقع حدودية أخرى يتم فيها احتجاز الوافدين، بما في ذلك ألبانيا.
كما يهدف المشروع إلى تقديم قراءة منهجية للقوانين وعلاقتها الديناميكية مع المجتمع للكشف عن الطبيعة الحقيقية لسياسات إدارة الحدود.
يعمل الفريق بدعم من لجنة خبراء مكونة من متخصصين قانونيين، بالإضافة إلى مجموعة متنقلة من المحامين الجاهزين للتدخل عند طلب الفريق الموجود على الأرض لحماية الأفراد الأجانب. يتم ذلك من خلال اتخاذ إجراءات فعلية ضد الانتهاكات المكتشفة، بما في ذلك تقديم دعاوى قضائية استراتيجية أمام المحاكم الوطنية والدولية.
يهدف مشروع إن ليمين أيضًا إلى تسهيل إنشاء شبكات وأشكال من التعاون التي يمكن، من خلال ارتباط علمي وعملي وثيق، أن تؤدي إلى استنساخ تجارب مماثلة في المناطق الحدودية. يسعى المشروع إلى تعزيز عمل مستمر وموسع لمواجهة سياسات تجريم الأشخاص المتنقلين الذين يدخلون الأراضي الإيطالية.
